By continuing to access the Emersion Pilates Studio or website you are agreeing to comply with and be bound by the following terms and conditions of use, which together with the privacy policy, govern Emersion Pilates’ relationship with you in relation to the website and studio. The term ‘you’ refers to the user or viewer of our website/studio. We reserve the right to update, change or replace any part of these Terms and Conditions at any time. It is your responsibility to check our website for changes. If you disagree with any part of these terms and conditions, please do not use this website.

STUDIO TERMS & CONDITIONS

Please read through the terms and conditions on our website thoroughly before enrolling for a class. When registering as a client at Emersion Pilates, you agree to the terms and conditions as laid out on our website, www.emersionpilates.co.nz

  • Our studio is an inclusive space. We will not tolerate any kind of discrimination or behaviour that creates a hostile and unpleasant environment for staff or members.

  • We endeavour to deliver all our classes on time and as advertised, however classes are subject to change or be cancelled without notice. Emersion Pilates is not liable to refund, transfer or offer compensation of any kind for classes that are late, changed or cancelled for any reason.

  • Out of consideration for the teacher and other clients we ask that you arrive at least 5 minutes before class. If you are late, you may not be let in so as not to disrupt the class.

  • If a class you would like to attend is fully booked please sign up to the waiting list. Should a place become available then you will be added automatically before the scheduled class. It is your responsibility to remove yourself from he waitlist should you not be able to attend in the end.

  • A minimum of 2 people per class is required for a class to go ahead. You will be contacted via text, phone or email should a class be cancelled and your session will be credited back to your account.

  • To book into a class you must either have a valid class pass on your account or pay at the time of booking. Classes are on a first come first serve basis and can be booked up to 14 days in advance.

  • Emersion Pilates is not responsible for the safekeeping of your belongings when attending a class in studio.

  • Emersion Pilates has the right to refuse entry at anytime. Our instructors reserve the right to direct clients to a particular class type for safety reasons; instructors also reserve the right to turn clients away for any reason they deem necessary.

  • Clients must follow the instructions given around how to use, operate and exercise on the Reformer and/or any other equipment that is used both in (and out if applicable) the studio. Failing to do so may result in you being asked to leave the studio and forfeiting your pass.

  • Classes at Emersion Pilates may be physically strenuous and you voluntarily participate in them with full knowledge that there is risk of personal injury or death. You agree to follow all instructions given to you by Emersion Pilates instructors and you acknowledge that any failure to do so will be at your own risk.

  • Emersion Pilates is in no way liable for any injury, loss of property or death resulting from attending our studio.

  • Because we rely on social media for advertising, there may be times when the class is filmed or pictures are taken to be put onto social media. If you prefer not to be shown in our videos and pictures on social media, it is your responsibility to tell the instructor at the start of class. We have no control over clients posting content that shows other clients in the studio; we may reshare this content on our social platforms.

  • By booking into and participating in a class you automatically agree to these terms & conditions.

PRICING & REFUNDS

  • All prices are quoted in New Zealand Dollars ($NZD) and all transactions are processed in New Zealand Dollars ($NZD). Prices, products and offers include GST.

  • All prices are correct at the time of online publication. Prices are subject to change without notice.

  • Sale items are only available at the lower price during the sale period.

  • Unforeseen supply problems or unexpected demand may occasionally result in stock being unavailable.

  • We reserve the right to amend prices and printing errors.

  • Prices may increase from time to time to reflect increases in cost and benefits.

  • All purchases are final. Emersion Pilates does not offer refunds, transfers, suspensions or extensions on services or products for change of mind, change of address or any other reason. We will consider extensions on class packs upon sudden injury, illness with a medical certificate and pandemic-related lockdowns.

  • All passes and memberships are non-transferable between clients.

  • Emersion Pilates reserves the right to bill the client the cost of any additional bank fees which may incur from disputed or failed transactions regarding a clients account.

  • All payments are processed through Stripe, which is a third party online payment system. Emersion Pilates has nothing to do with any additional fees that may be charged as a result to clients having insufficient funds during payments.

  • Refunds will not be given unless goods/services are not provided and an extension on validity of Passes is not an option.

INTRO OFFERS:

  • Intro Offer Coupons are available only once per person.

  • Redeeming of the code is done on the home page or at checkout when booking in for your Private 1:1.

  • Clients found to be using multiple accounts to purchase our intro offer more than once will be charged at the price of a casual class for all classes attended after the initial intro offer used. Additional penalties may apply.

PASSES:

  • 5 x Small Group Reformer Pass - Price $210. Redeemable for 5 x Small Group Classes. Must be used within 2 months of purchase date.

  • 10 x Small Group Reformer Pass - Price $400. Redeemable for 10 x Small Group Classes. Must be used within 3 months of purchase date.

  • 5 x Private 1:1 Reformer Pass - Price $425. Redeemable for 5 x Private 1:1 Sessions. Must be used within 2 months of purchase date.

  • All passes cannot be transferred to another client.

  • No extensions on any passes.

  • Limited space per class so preferred class cannot be guaranteed.

  • We recommend booking all classes in advance as refunds will not be given if you are unable to attend.

  • Classes as part of a class pass will not be refunded for late cancellations or no-shows.

  • Refunds will not be given for remaining classes if you are no longer able to make classes or your pass expires before all classes have been used.

  • Emersion Pilates has the right to terminate a pass without notice for any unsatisfactory behaviour or other reasons decided by us, which occurs on our premises, in writing, or is directed at our staff or other members.

  • Prices may increase from time to time to reflect increases in cost and benefits.

CANCELLATION POLICY:

  • Our Cancellation policies are in place to ensure that everyone has inclusive access to classes.

  • Please be considerate of others and cancel your spot to free your space for someone else to have the chance to book.

  • Cancellations are the responsibility of the person booking the class. They must be made using your account on this site.

  • We do not accept cancellations via email, phone or social media.

  • Cancellations made more than 24 hours before classes will get the session back.

  • Late cancellations made less than 24 hours before classes will forfeit the session.

  • No-shows and absences will forfeit the session.

MEMBERSHIPS​:

  • The Obligation Agreement Term is 3 months: An Obligation Agreement means an agreement that has a specific term commitment to maintain payments which in this case the term is 3 months.

  • The client must pay all fees and charges including GST as applicable, for the term of their membership. If payment is not successful, your Membership will be paused and you will be unable to attend or book classes until your payment is successful. If payment is not received within 7 days of the weekly payment day, the Membership will be terminated and fees may apply at the discretion of Emersion Pilates.

  • Late cancellations (less than 24 hours), and non-attendance to any booked session will result in a lost session/additional charge if all sessions are allocated.

  • Fortnightly payment will be taken within 24 hours of the chosen date. If the date falls on a weekend day or a public holiday the time period will be within 24 hours from the start of the next business day. A dishonour fee may be charged if there are insufficient funds (we cannot provide a refund as this charge is made by our online payment provider Stripe).

  • It is the responsibility of the client to book their classes in advance. Refunds or make up classes will not be given if a client fails to book ahead and classes are booked out. 

  • Because payments are fortnightly, clients have 2 weeks once the payment comes out to use spread the number of classes over the fortnight starting the day of payment.

  • Emersion Pilates may adjust membership fees at any time giving 21 days’ notice.

  • Clients are entitled to apply to put their membership on hold for a maximum of 1 week over a 3 month period. A client may apply to pause their membership, giving 14 days notice via email due to medical, travel or personal reasons. Clients will not have access to any bookings or facilities that form part of the Agreement while the pause is in place. Longer periods will incur an admin fee of $10/week paid as an upfront payment before the Membership is paused. 

  • Signing up to a Membership is a legal commitment. Cancellations of the Membership prior to the Obligation Agreement term will ONLY be considered if there is serious illness or injury (a medical certificate must be supplied).

  • If any balance is outstanding for more than 4 weeks Emersion Pilates may notify any credit reporting or referencing agency of the default, and may pass the customer’s debt for collection to a third party agency.

  • Memberships and perks for Membership clients are strictly non-transferable to other clients.

PRIVACY POLICY:

We are committed to ensuring that your information is secure. In order to prevent loss, misuse, unauthorised access, modification, disclosure, alteration, or destruction we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. However, you should keep in mind that the transmission of information over the Internet is not completely secure or error-free. In particular, e-mails sent to or from our website may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail. We may collect the following information:

Payment history
Demographic information such as postcode
Other information relevant to customer surveys and/or offers
